These Terms of Use ("Terms") are an agreement between you and Théophile de Cagny ("we", "us", or "our") governing your use of the Safari Companion mobile app for iOS and Android (the "App"). They also serve as the End User License Agreement (EULA) for the App. Please read them carefully.
By downloading, installing, or using Safari Companion, you agree to these Terms. If you do not agree, please do not install or use the App. If you are using the App on behalf of someone else, you confirm that you are authorized to accept these Terms on their behalf.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use Safari Companion on devices that you own or control, for your own personal, non-commercial use.

We (and our licensors) retain all rights, title, and interest in and to the App that are not expressly granted to you under these Terms.
Safari Companion offers a single one-time, non-consumable in-app purchase ("Pro") that unlocks additional features. Key points:
Safari Companion provides wildlife identification tips, species information, trip-preparation suggestions, and similar content for general informational and educational purposes only. This content is offered as guidance and is not guaranteed to be accurate, complete, or up to date for your specific situation.
Safari safety is your responsibility. Wild animals are unpredictable and can be dangerous. You must not rely on the App for safety decisions in the field. Always follow the instructions of qualified guides, park rangers, and local authorities, and comply with all park rules and local laws. Do not use the App to determine whether it is safe to approach, feed, or interact with any animal. We are not responsible for any decision you make based on information in the App.
Some species photos bundled with the App are sourced from Wikimedia Commons and are used under their respective open licenses. Attribution and license information for these images is provided in the App's in-app Credits screen. These images remain the property of their respective authors and are subject to their own license terms, which you should review if you intend to reuse them outside the App. The presence of an image in the App does not transfer any rights to you beyond using the App as licensed.
The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any information it provides is accurate or reliable. You use the App at your own risk.
To the fullest extent permitted by applicable law, in no event will Théophile de Cagny be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability for all claims relating to the App will not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you. In that case, our liability is limited to the smallest extent permitted by law.
We may update these Terms from time to time, for example to reflect changes to the App or to legal requirements. When we do, we will update the "Effective date" at the top of this page and post the revised Terms at the same location. Your continued use of the App after an update means you accept the revised Terms. If you do not agree to the updated Terms, please stop using the App.
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict-of-laws rules. Any disputes arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the courts located in Paris, France, except where applicable law grants you the right to bring proceedings elsewhere.
If you obtained the App through the Apple App Store or Google Play, you also agree to comply with the applicable store's terms of service, and any conflict between those store terms and these Terms regarding store-related matters will be resolved in favor of the store terms to the extent required.
